1. 1. Come to Japan with a large amount of debt
Technical intern trainees pay a large amount of money before coming to Japan. The costs are used for education and training, travel expenses, placement fees for sending organizations and brokers, and sometimes bribes to related organizations. The average amount in Vietnam is 1 million yen, but technical intern trainees borrow money from financial institutions to pay the cost. As a result, technical intern trainees will not be able to speak out even if they are treated unfairly or infringed on human rights by the supervising organization or the practitioner. This is because if you make a claim and are forced to quit during the technical intern training, only a large amount of debt will remain. In this way, the large cost of visiting Japan functions as a device for debt enslavement of technical intern trainees.
3. Unintentional forced return
If a technical intern trainee claims his rights to the trainee or a supervising organization due to being treated unfairly in the workplace, not only will he not hear the complaint, but he will be detained without warning and taken to the airport. It can happen that you go and are sent back to your home country. This is called forced return. Even if it is not actually done, it is used as a daily threatening phrase and exerts the effect of suppressing rights. It is mainly the people involved in the supervising organization and the sending organization that carry out the forced return. Due to the unilateral circumstances of the trainee or the supervising organization, the technical intern trainee should not be returned to Japan against his will during the training period. The government has expressed a similar view and confirmed the intention of returnees when they left the country, but it is not very effective. In addition, there are no laws or penalties prohibiting forced return.
5. Low wage, long working hours, overtime pay 300 yen per hour
The wages of technical intern trainees are extremely low among foreign workers, and they are sticking to the amount close to the minimum wage in each region. In addition, wages have not been paid, long working hours from early morning to late night, and overtime pay of 300 yen per hour have been confirmed. Behind this is the heavy burden of practitioners. According to a survey conducted by the Organization for Technical Intern Training for Foreigners, the average monthly supervision fee paid by a trainee for each technical intern trainee is about 30,000 yen. In addition, the intern trainee will eventually bear the cost of the "training" that is held for 1 to 2 months at the beginning of the technical intern training and the travel expenses for returning to Japan. These various burdens, which are not found in other systems, act as downward pressure on the wages of technical intern trainees.
7. 70% of technical intern trainees' workplaces violate labor standards-related laws and regulations
The Ministry of Health, Labor and Welfare announces "the status of supervision and guidance for trainees of foreign technical intern trainees, sending inspections, etc." every year. Violations have been found. The contents are wide-ranging, such as working hours, non-payment of extra wages, non-payment of wages, clarification of working conditions, and safety and health. In addition, there are cases where serious or malicious violations of labor standards-related laws and regulations are sent. However, it has not led to major improvements.
9. There is an upper limit to the period of stay and you must return to Japan.
Most technical intern trainees can work in Japan for 3 years, up to 5 years, and they must return to Japan after completing the training (although there is a way to move to Specified Skill No. 1 depending on the conditions, it is specific. Skill No. 1 also has an upper limit of 5 years in total). Also, in Vietnam and other countries, the reemployment rate after returning to Japan is low, and there is no guarantee that the work learned over 5 to 10 years can be utilized even if it is brought back to the home country. On the other hand, it is a big pain for the host organization, the industry concerned, and the local community to have to let go of the human resources that they have cultivated.
2. No freedom to change jobs
Since the purpose of technical intern trainees is to acquire skills, they must practice under the same trainee, and in principle, they are not allowed to change jobs. As a result, the employer's dependence on the practitioner is increasing. On the other hand, in addition to human rights violations, if there are problems such as labor-management problems or interpersonal relationships, it is said that the training destination can be changed. It is supposed to be. However, it is not easy to change the training destination because the supervising organization tends to prioritize the intention of the trainee over the circumstances of the technical intern trainee. The ILO has included in the "List of Signs of Possibility of Forced Labor" for work styles that are fixed only to specific employers.
4. Control by supervising organization / sending organization
Technical intern trainees will conclude a contract with the sending organization in their home country when they come to Japan. The sending organization will mediate the recruited technical intern trainees to the supervising organization on the Japanese side. Technical intern trainees enter into labor contracts with companies that are practitioners in order to work in Japan, but the supervising organization will accept them in Japan, introduce them to practitioners, and supervise technical intern training. As a result, technical intern trainees are placed in a position that is easily influenced by the intentions of the supervising organization. On the other hand, the trainee, who is the employer of the technical intern trainee for the supervision organization, is also a business partner who pays the supervision fee including various fees. Therefore, even if labor problems occur, the supervising organization tends to prioritize the interests of the trainees over the relief and protection of the rights of technical intern trainees. In addition, the sending organization may also intervene excessively to private, such as by assigning a representative to Japan to monitor the status of technical intern trainees.
6. Treated as "disappeared" when evacuated from violence or harassment
Technical intern trainees are suffering from serious violence and harassment in the workplace. In addition to physical violence, many reports of mental violence, sexual violence, sexual harassment, and racist responses have been reported to support groups. When a technical intern trainee leaves the workplace to escape such damage, it is treated as "disappearance". In addition, if the period of stay expires or the status of residence is revoked, you will be accused of violating the Immigration Control and Refuge. 8. The right to pregnancy, childbirth and childcare is not recognized
Technical intern trainees are considered to be just a labor force and are not supposed to be pregnant, give birth or raise children in Japan. Many technical intern trainees have had undesired abortions, isolated births, stillbirths, and abandoned children who were born with no choice but to raise criminal charges. The government has issued a warning document to supervising organizations and practitioners not to treat technical intern trainees in a disadvantageous manner because of pregnancy or childbirth, but a system is in place to substantially guarantee that right. not. The Ministry of Justice has stated that in order to allow a "family stay", it is necessary to reach a consensus on the cost burden of the entire society. However, it is not up to the government or society to decide whether to give birth or not, and the born child has the right to the best interests.
10. The technical intern training system is a camouflage for accepting cheap labor.
